CLAIMS ARISING FROM DISCRIMINATION (AGG claims)
1. What is insured
1.1 Damages due to discrimination
Claims by third parties are insured based on legal liability provisions of a private nature for damages incurred due to the violation of a regulation protecting against discrimination for the reasons stated in paragraph 1.2. Regulations protecting against discrimination are particularly found in the General Equal Treatment Act (AGG).
Insurance coverage includes personal, property, and financial damages as well as immaterial damages.
Legal bases for immaterial damages include, for example, § 15 paragraph 2 sentence 1 and § 21 paragraph 2 sentence 3 AGG.
1.2 Reasons for discrimination
Reasons for discrimination are
- Race,
- Ethnic origin,
- Gender,
- Religion,
- Worldview,
- Disability,
- Age, or
- Sexual identity.
1.3 Insurance coverage for revocation requests or injunction claims
It is clarified that insurance coverage also extends to cases where a written revocation request or injunction claim is made against the policyholder and/or the insured persons.
2. Bankruptcy
In the event of your insolvency, coverage only extends to liability claims resulting from such discriminations committed before the initiation of the insolvency proceedings.
3. What is not insured
In addition to Paragraph II of the insurance conditions for Shops by Hiscox, insurance coverage is also not granted for:
3.1 Claims for the company's liabilities
There is no insurance coverage in the event that insured persons as partners are held liable for the company's liabilities.
3.2 Claims by insured members of executive and supervisory bodies
Excluded are liability claims asserted by insured former, current, and future members of executive bodies (board, managing director, etc.) and supervisory bodies (supervisory board, advisory board, board of directors, etc.) of the policyholder.
3.3 Liability claims with a foreign connection
Also not insured are the following liability claims with a foreign connection.
3.3.1 Liability claims brought before non-European courts. This also applies in the case of a domestic enforcement judgment (§ 722 ZPO).
3.3.2 Liability claims brought on the basis of non-European law.
3.3.3 Liability claims arising from activities outside of Europe.
3.3.4 European countries within the meaning of this exclusion include all member states of the European Union as well as Switzerland, Norway, and the United Kingdom (even after its withdrawal from the European Union).
3.3.5 Common Law states and Common Law
Also excluded are the following liability claims:
3.3.5.1 Liability claims brought before a court in a Common Law state. This also applies in the case of a domestic enforcement judgment (§ 722 ZPO).
3.3.5.2 Liability claims brought on the basis of the law of a Common Law state.
3.3.5.3 Common Law states within the meaning of this exclusion are the United Kingdom of Great Britain and Northern Ireland, Ireland, and countries applying the law or jurisprudence of the aforementioned countries.
3.4 Claims related to collective labor law and labor disputes
Excluded are liability claims related to the violation or assertion of collective labor rights, namely the Works Constitution Act or comparable foreign legal regulations, as well as in connection with labor dispute measures. Claims under § 17 paragraph 2 AGG are not affected by this exclusion.
3.5 Claims arising from occupational accidents and occupational diseases
Excluded are liability claims for personal injuries that are occupational accidents and occupational diseases according to Book VII of the Social Code in your company. Clause 1.1.1 AHB remains unaffected.
3.6 Claims for performance and surrogates under § 281 BGB in connection with § 280 BGB
Finally, claims for performance and surrogates under § 281 BGB in connection with § 280 BGB are excluded. Claims under §§ 15 and 21 AGG are not affected by this exclusion.
Insurance coverage for the mentioned claims exists up to the contractually agreed compensation limit. When concluding the Shops by Hiscox - Professional Liability Insurance for Online and Retail Trade conditions, these claims are exclusively insured through the Professional Liability Insurance module. In this case, the insurance sums, deductibles, and compensation limits agreed there apply.

VIOLATION OF INDUSTRIAL PROPERTY RIGHTS, PUBLICATION RISKS
The insurer also provides insurance coverage to the insured for claims by third parties for (immaterial) damages, reimbursement of futile expenses, or lost profits due to the violation of intellectual property rights and (industrial) property rights such as
- Trademark, domain, license, and copyright;
- Name and personality rights (including claims for pain and suffering);
- Competition and antitrust law as well as unfair advertising;
- Claims arising from publications (e.g., on websites, social media, or blogs) related to the products and services of the insured.
Insurance coverage for the mentioned claims exists up to the contractually agreed compensation limit. When concluding the Shops by Hiscox - Professional Liability Insurance for Online and Retail Trade conditions, these claims are exclusively insured through the Professional Liability Insurance module. In this case, the insurance sums, deductibles, and compensation limits agreed there apply.

ADDITIONAL INSURED
The policyholder has entered into an agreement with Amazon.com Services LLC. and its affiliated companies, subsidiaries, and successors in which he undertakes to include Amazon.com Services LLC. and its affiliated companies, subsidiaries, and successors in his insurance contract and to indemnify them against all third-party liability claims.
In this context, insurance coverage exists to the extent specified in the conditions under the following conditions:
- It is a legal liability claim;
- The policyholder is at fault for the claimed damage;
- A claim is asserted for which the policyholder would be liable if directly sued;
- The claim does not relate to additional services or changes to the product by the co-insured;
- The co-insured has not acknowledged the claim to the claimant and complies with the contractual obligations after the occurrence of the insurance event.

SPATIAL SCOPE USA / CANADA
1. In addition to the agreed-upon Professional Liability Insurance conditions as well as Business Liability Insurance conditions, insurance coverage also exists for claims asserted before courts in the USA or Canada or based on the violation of the law of these states.
2. In addition to the agreed-upon insurance conditions, no insurance coverage is granted for claims due to the discrimination or harassment of persons during the initiation, existence, or termination of an employment relationship.
3. The minimum deductible for claims asserted before courts in the USA or Canada or based on the violation of the law of these states is €15,000.
4. To the extent claims are asserted

before courts in the USA or Canada, the costs incurred are credited against the agreed-upon insurance sum or compensation limit.
